Smoking Patios Come to Derby



To comply with the city of Derby’s new Clean Indoor Air Ordinance, five drinking establishments in Derby plan to
construct outdoor patios between now and New Year's Eve.

The ordinance requires that beginning September 1, 2008, there is to be no smoking in public places and places of employment, and no smoking within 20 feet of the main entrances of such facilities. The Green Derby, Little Buster’s, Michelle’s Beach House, The Shop, and the VFW requested and were approved more time to continue to allow smoking
inside while they construct patios.

“The city realizes that contractors have backlogs of work, and these clubs have tried in good faith to get their design, state approval, and construction moving along,” said Derby city manager Kathy Sexton. “We are happy to work with these valued Derby businesses to get their patios built by the end of the year.”

For these five businesses, smoking will continue to be allowed inside until their outdoor serving areas are constructed or until January 1, 2009, whichever comes first.

Another application for extension is pending for Bombshells. All other licensed drinking establishments have indicated they have no plans to build patios.

As of Monday, September 1, no smoking is allowed inside or within 20 feet of the main entrance of all public places and places of employment, including all restaurants and bars, except those granted extensions.

In July, the City of Derby’s governing body passed a comprehensive clean indoor air ordinance to improve and protect the public’s health by eliminating smoking in enclosed public places, to assure nonsmokers of the right to breathe smoke-free air while indoors, and to recognize that the need to breathe smoke-free air has priority over the choice to
smoke.
