Fantasy Football Illegal in Kansas



WICHITA - It's all over the internet, including big sites like Yahoo!, CBS and the NFL. They are all touting their fantasy football leagues.

"I have a bunch of friends from back in college," said fantasy football player Dustin Stos. "It's our tenth year, so it's our way of keeping in touch." Aaron Biggs plays in three leagues, hoping to win up to $1,000.

Not really going to affect me much," said Biggs after KAKE News told him he was breaking the law. "I'm too far into it, and people been doing it for too long to care."

Kansas statute 21-6404 says, "As with any other illegal gambling matter, if a fantasy sports league involves the elements of a prize, chance and consideration then it is an illegal 'lottery' prohibited by Kansas criminal law."

Forbes Magazine is even writing about the Kansas law, saying Kansas takes steps to outlaw fantasy football. The Kansas Gaming Commission said it's been illegal to bet on fantasy football for years. The law just popped up on its site under frequently asked questions drawing more attention.

Sedgwick County District Attorney Marc Bennett says if you are paying to play, there's a prize and you are taking a chance in the game, then you are subject to prosecution.
